These terms govern the AI video service provided by Toucan Tech Inc, a Colorado corporation, at 1500 N Grant St, Ste R, Denver, CO 80203, United States. Contact besttools1988@gmail.com. By affirmatively accepting these terms you agree to them; the Privacy policy explains data handling and the Refund policy explains refund reviews. If you cannot agree, do not create an account, purchase credits or submit media.
Eligibility and your account
You must be at least 18 and legally able to contract. Keep your account and contact information secure and accurate. No under-18 person may be depicted in uploaded media, including with parental permission. Upload only your own photos or material you are entitled to use, with informed permission from every adult depicted for AI alteration and your intended distribution. Do not bypass the age gate or use someone else’s identity. Report suspected child use through Contact → Child safety.
Permission to process your content
You retain your existing rights in your uploads. You grant us a limited, non-exclusive permission to host, transmit, reproduce and transform them, including through our AI providers, only to deliver your requests, protect the service, handle complaints and meet legal duties. This does not authorize us to use your portrait in advertisements, publish it in a showcase, or train our own models on it. Separate permission would be required for those uses. Permission ends when those purposes and necessary retention end, subject to lawful records and provider handling disclosed in the Privacy policy.
Prohibited content and conduct
Do not submit minors’ images, sexual exploitation, nudification or non-consensual intimate media, harassment, threats, discriminatory abuse, fraud, deceptive impersonation, election deception or content that violates privacy, publicity or intellectual-property rights. Do not imply a public figure’s endorsement without authorization. Do not use the service for identity verification, sensitive-trait inference, illegal surveillance, circumventing moderation, unauthorized access or manipulating payments or credits. You must comply with applicable provider rules and laws. We may reject or restrict unlawful or unsafe requests.
Templates and third-party references
Template previews may contain third-party source footage and reference frames; these are not proof of an output generated from the displayed photos. Names, clips, music and likenesses may belong to others. A purchase does not grant rights to reference footage, songs, trademarks, characters or a person’s identity. We are independent of TikTok, Instagram, YouTube and referenced creators or artists. These notices do not excuse us or users from obtaining permissions required for our respective uses.
Generated results and permitted use
Subject to these terms, applicable provider conditions and third-party rights, you may download and use your output, including commercially where you have all necessary permissions. We do not claim your pre-existing content rights. AI output may be inaccurate, non-exclusive or ineligible for copyright protection; no exclusive ownership or non-infringement guarantee is given. Check every result before sharing and apply AI labels or disclosures required by the platform or law. We do not guarantee identical faces, motion, audio, timing, virality, earnings or a particular audience response.
Payments, credits and subscriptions
Pricing and checkout show the currency, charge, included credits, billing period and any applicable expiry or taxes. The selected quality determines the credit cost shown before generation. Credits are a limited service allowance, not cash, a bank deposit or a transferable investment. One-time packs do not renew. A recurring plan renews on its disclosed schedule until canceled through Billing; review the effective cancellation date. Do not rely on a template video’s popularity as an earnings promise. Material price changes apply prospectively with notice required by law.
Failures, refunds and consumer rights
A first purchase with unused credits may be submitted for refund review within 7 days of payment. Confirmed failed or canceled generations return their generation credits once; pending or unconfirmed jobs need reconciliation before retrying. A successful generation does not automatically qualify for a refund merely because appearance differs from a reference. Canceling a subscription does not by itself refund an earlier charge. The Refund policy gives details. Mandatory rights, remedies for defective services, and any applicable withdrawal period remain intact; this acceptance is not a waiver of those rights.
Suspension, closure and appeals
We may restrict requests or accounts for credible safety concerns, violations, fraud, legal requirements or security incidents. Where appropriate and lawful, we explain the action and allow a review request through Contact. Use Privacy & data to request closure; active jobs, subscriptions or unsettled payments may need separate reconciliation. Closure does not cancel legal privacy rights or obligations. We apply mandatory refund and consumer protections when access is terminated and do not impose a blanket forfeiture of every unused credit.
Copyright, likeness and safety reports
Anyone may report content through Contact without an account. Choose Copyright, Abuse, Child safety or Non-consensual intimate imagery and provide a reachable email, the exact URL or task reference, the rights or harm concerned, and your authority to report. For a copyright notice, identify the protected work, allegedly infringing location, your good-faith and accuracy statements and electronic signature; include a statement under penalty of perjury that you are authorized to act. Do not attach intimate images or children’s images. We review reports, restrict or remove material where warranted, and follow applicable legal deadlines. This contact process does not claim a registered DMCA-agent status or automatic safe-harbor protection.
Availability and limits of liability
To the extent permitted by law, the service is offered as available without a promise of uninterrupted or error-free generation. We are not liable for indirect or consequential losses to the extent law permits. Our aggregate liability connected with the service is limited to the greater of USD 100 or the fees you paid us in the preceding 12 months, only where such a limit is enforceable. These limitations do not exclude fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or liability and consumer or data-protection remedies that cannot lawfully be limited.
Applicable law and disputes
Colorado law governs to the extent permitted, without depriving consumers of mandatory protections of their place of residence. Courts with competent jurisdiction in Colorado may hear disputes; consumers retain any mandatory right to bring a claim in their home jurisdiction. Contact us to seek resolution, but doing so is not a mandatory waiver of legal deadlines or access to a regulator or court. These terms do not impose mandatory arbitration or a blanket class-action waiver.
Changes and interpretation
We will date changes and give appropriate notice of material changes before they take effect, obtaining renewed acceptance where required. Changes do not retroactively remove accrued consumer rights or authorize new uses of previously uploaded content. If a provision is unenforceable, the remaining lawful provisions continue. Localized versions assist users; any interpretation must respect mandatory local law. Contact us about an inconsistency rather than assuming an English-language clause overrides your statutory rights.
